Hi

I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-

(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?

(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?

(3) Can I return to US & work after my AP & EAD are approved?

(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

My Husband's I 140 got approved and his lawyer included my name as well in the I 140 application.

Can some one plss help me by letting me know if I can change to F1 for my further studies inspite of my name being included in the I 140 application

Plss let me know at the earliest possible as I need to apply for change of status before may....!!!!!

Hi - I am just wondering, if Medical residency applications are subject to the yearly 65,000 Quota? Does anyone know?


If the hospital (healthcare organization) is a non-profit body then they will not be subjected to the quota (I think). Maybe other members can validate this.

Just need some suggestion:

I may be on the chopping block next week..
currently am on my 8th year H1, expires march 2010..so less than a year to restart..and be back in the line. (spouse on H1)

My 140 is pending...

so if i lose my job.. can i go to H4.. even though i have stayed here for more than 6 years..
and in case if i get job ...can i get back on H1 and restart GC?

i am thinking.. i have come to the end of all options.. and the only course available for me is back to desh..any inputs..will be appretiated..

Hello,

It has been over two years I got my EAD, and I am also on H1 and my H1 is valid up to May, 2011. Now, if I want to switch to a new employer, I want to know if there are any complications...I read that we can always switch to new employer and can still retain the priority dates. Is it true? What is NOID? Is it possible for the old employer to revoke my I-485? or can they do anything that affects my Green Card status or the legal status in the country?

Guys,
I need to find out what documents I need to send after I file I-765 online. DO anyone has the experience in this matter. I filed my I-485 and at tht time i did not filed my I756 just to avoid lawyer's fee.

The form says I need to send a copy of I-94 and photo thats all, but the confirmation notice I received after filing the form online said that do not send any photo's or any identification document and the notice said that they will sent me a Biometric appointment.

DO anyone has info on this

I have MS+2 yrs of experience(software engineer). The company i am thinking to join is in Boston.


I am guessing boston is a highly educated town with many young graduates roaming around. Having said that, will this be an issue while we send out an ad for MS+2 yrs as there might be several responses to the ad and refuting all of them would be difficult ?


Please let me know, if I am THINKING CRAZY or this is TRUE. Another option i have is a company in chicago. Not sure where will I be better off as far as GC is concerned.

Also, anybody heard of MONIQUE KORNFELD immigration attorney based out of Newton, Massachussets ??? If so, please let me know about her expertise. I JUST can't find out how many yrs she has been practising immigration.

I am from California. One of the requirement as you all know is Notice of Job posting with SWA. We have a new person in our HR who deals with immigration the earlier one left .
Problem Description: According to our new HR posting jobs on http://www.caljobs.ca.gov/
is equivalent to Notice of Job posting. Can anyone from California confirm if that is true. If there is additional method can you provide the details or any link.

Hi Forum,

My wife has an H1B visa which has been invalidated now because she had to travel to US with me on H4. Her petition seem to be valid. The I94 in her passport has H4 mentioned on it. Now we want to convert her visa back to H1. Since she has H1, I am wondering the H4 to H1 conversion process should be easier compare to applying fresh H1.

It would be great if you guys let me know what is the process of converting this without going back to home country.

my GC job title is programmer analyst(15-1021.00), and curently working as a Sr.Programmer analyst using EAD with different company.

Now they are promoting me as a Applications Project Lead, most of my job dutie are same as programmer plus some additional role.

I dont know whether I can accept this promoton or not, I sent a mail to lawyer, mean while if any one of you have similar experience please advice
