    If you are replaceable then you have false claimed in your application that no American is available for your job. It defeats your H1B and Green card application. America invites H1Bs and gives them greencards not because they are paying taxes but because employers prove no american is available for our job and we have unique skills for job. 'Best and Brightest' is we are and USA needs us. Without us the economy will be more bad.

    You must be dumb. Did you read the whole sentence and if you cannot comprehend what I am trying to say, you must be incapable of understanding it. I said in TODAYS WORLD. The world is changing very fast. GC process takes 10 years now.
    I am sure whatever technology you are working on, there are 100 more people capable of filling that position as of now. So, even your so called skilled position can be filled within few days. USCIS interprets even today, what the conditions were at the time of filing. Not what the current job/wage or labor market conditions are.

    It looks like guys from AP are running away from all the mess their state is currently in. On one hand there's that YSR's son trying to create havoc for the ruling Govt. His dad and himself being the most corrupt politicians the state has ever seen. On the other hand, there's this filthy congress high command trying to counter him. Its like CORRUPT1 vs CORRUPT2 trying to get the throne so that they can remain CORRUPT. And in the wings are parties like TDP, TRS and PRP --- Really, is there a political party in AP (or even India) where one can call it corrupt free? ha ha

    I'm not a gulti, but I don't think u can really blame them :). Unfortunate but true :mad:

    This is an extremely childish argument. In all honesty, the rules are the rules, we do not make them and nor do we interpret them. In the past the way the rules were interpreted favored EB3 over EB2I. Last year they said they took another look at the language and interpreted the rules as they should have been all along. At that time, there was much argument within this board and others. Those like me kept saying that EB immigration has always had a skills hierarchy and from the language EB category took precedence over country of origin quotas(which were discriminatory anyway). Others including popular posters like UN and lawyers like Ron Gotcher took the other view. In the end the state Dept. decided with the Eb category precedence and horizontal spillover. Should those that suffered the misinterpretation in 2006/7 ask for reallotment of future flows of visas to redress that injustice? No.
    Likewise, many people got the opportunity to file 485s in the summer fiasco. There were hundreds of thousands of people who had already filed and were waiting for years by then, but the USCIS was being their usual inefficient self and not doing squat with their application. Were they not wronged? What about their total lack of respect for the FIFO policy? How would one of you feel in 2012 if someone who filed in 2012 and with a PD the same as or later than you get approved first?
    These are process issues. There are many flaws in the system. Complaining when it grieves you and smiling when it suits you is not correct.
    You guys need to learn to put the mission ahead of your personal interests. IN the interim, if you are able to migrate to EB2 and are confident in your case to be able to do that, then do so. However complaining on and on, and deligitimizing the whole advocacy effort is not how you get your goals accomplished. The singular best solution for everyone is visa recapture. If there was broad participation by everyone affected, I believe it would have happened already. EB3 v EB2 battles and other fault line battles accomplish nothing. Letters to officials along these divisive lines, while it may pacify your anguish a bit, make the community a laughing stock.

    Thanks for your detailed postings.

    One question to Kumar and other knowledgeable readers here.

    My child is now over 21 years of age, however is OK with our present EB-3 filing. We all are on EAD. Now if I go for EB-2 route, my doubt is that my child who is already 21 plus years, will not be eligible to be beneficiary in this new EB-2 route...or is there any way?

    In the case of this guy. I can't fault him/her for taking up this option. None of us can. After all, he is playing by the rules right?
    That we are affected does not matter here to the authorities. Why? Once again I ask you guys to realise that this immigration system is here to serve the employers, not you or me. That is why they can justify this.

    I can give you my example. 10 years in the US and got greened yesterday. Background -

    B. Tech. from IIT - 1999. Always believed in hard work and dedication.
    2000/2001 - Came to the US
    2003 - Filed labor - RIR - EB3
    2004 - job loss
    2004 - Joined so called fortune 500 company with 15000 + employees and presence in 50 countries. They promised but never filed GC.
    2005 - Filed Canada PR.
    2005 - Quit and joined Desi company. Started GC process on day-1.
    2005- Filed under Perm EB-3 (lawyer screwed). Got approved in 3 months.
    2006 - Filed I-140 got approved in 3 weeks.
    2007 - July Fiasco and filed I-485. Got AP, EAD. Wife started to work.
    2008 - EB-3 sucked so talked to employer to file in EB-2. Desi company did not care as long as I paid for it.
    2009 - Filed labor, got approved in 6 months.
    2009 - Filed EB2 I-140 and requested to re-capture the PD of first labor.
    2009 - I-140 approved, same day saw an LUD on pending I-485. Also, approved I-140 came with A# and EB-3 labor PD.
    2009 - Bought a home.
    2010 - July, dates became current.
    Opened SR, got a response that my case is still in EB3. NSC sucks.
    Asked lawyer to send letter to USCIS. He did, nothing happened.
    Contacted senator and they opened up a congressional request with USCIS.
    Within 2 days, USCIS issued RFE about incomplete medical. It was total BS.
    Contacted doctor and got chest X-Ray and replied RFE.
    Took several Inforpass appointments.
    EAD expired, did everything but could not get renewed on time.
    Did not tell anything to HR about expired EAD, both kept mum and kept working.
    Had fights at DMV to get DL extended.
    Aug-17th, GC got approved.

    Is this all worth it? I do not know. Only reason I joined desi company with 2 employees is that desi company was ready to file GC on day-1. I have seen so called Fortune-xx companies. They lied to me.

    Overall - I am a happy person. Would continue with Desi employer for some more time.

    Now that we have GC, I would like to -
    1. Spend more time with family and not worry about LIN-XXXX numbers.
    2. Think about doing MBA.
    3. Move to a warmer place like CA.

    Good Luck. I would suggest - Talk to your employer and explain your situation. You have nothing to lose.

    fedex = $50
    gas = $30
    passport fotos = $50
    photocopying = $20
    birthcertificate from india+courier = $30
    uscis fees + lawyer fees (paid by employer)

    2 days off (for medical visits)
    8 hours waiting at doctors office for medicals
    + priceless feeling guilty of troubling old age parents to get birth certificates done

    This thread seems to express my thoughts.
    I used to wait till my dates got current. With my dates being current since November, I still wait with no sign of improvement.
    I tried calling the 1-800 number. But, did not get any useful information.
    Took an Infopass appointment couple of weeks back. But, it was of no use.
    The officer at the local office read the same status that I see online.
    She said that my case was transfered to Texas center. (I knew this since October 2007). Only additional information she gave me was that my namecheck got clreared. (Though this is important, I dont think this really matters to get my case processed).

    I told her that I have been waiting since years and some of friends who filed later than me already got their GCs, she felt sorry for me but she said there is nothing she can do for me. Not even a Service Request since my dates are within the processing times.

    Its getting difficult for me......Also, in this economy its getting tough everyday to hold on to the job. Who knows may be this year quota might be over too. It will definitely be a big relief if we get the GC.
    I thought there is nothing I can do now till my dates goes outside the processing times. Please advice.

    (d) Form I-140 Petition Must be Approved Prior to a Favorable Determination of a �106(c) AC21 portability request.

    this could be read 2 ways...either you need have an approved I-140 prior to filing for portability OR the adjudicator needs to approve the I-140 prior to determining portability.



    According to the 2005 memorandum, it was possible to change employers even if the 140 was not approved. But it was clear that an RFE that was not responded to, would deny everything.

    Now it appears, they would require an approved 140.

    I tried to recruit 3 guys with 7-8 yrs of experience. We already have a 12 member offshore team...the average asking rate (H1s and citizens) is 90K ..H1B quota restriction is working in our favor very much. Market rate for IT professionals has increased quite handsomely..put ur resume out to dice or monster and see for urselves.

    I don't think 90k for someone with 7-8 years of experience is high in most parts of US. Market rate for IT professionals might have increased in people working with niche technologies. But in general, I see a down trend. And with more people in the job market in Jan 08 (with AC21), I can predict the rates heading south.
