Now my hunch is that risk no. 1 is a low risk. Either the dates won't retrogress again, or even if they do, they will move forward in October again. So we can live with that.
Risk no. 2 is a bigger risk. But can USCIS take a decision on my I-485 petition so quickly. I don't think so. But if it does, then we lovers will be torn apart.
And lastly, has anybody ever heard of "Follow to join" procedure? What exactly is it and can we utilize it to our benefit?
If your GC is approved before your wife can enter US and apply for I-485, then she can do "following to join" through consular processing. The apparent wisdom seems to be that the application has to be done quite quickly, but I had read in one website that there is no time limit to apply (it is possible that the law changed in that regard; you need to seek a competent lawyer's advice and check the current rules). I also read that visa numbers are not required for following to join; i.e., she can get GC even if PD retrogrades. Again, that could be a outdated law, or perhaps that wording was for the "following to join" procedure for the spouses of US citizens. In any case, if you act quickly and properly, there is not much to worry about not being able to get your wife into US after your GC.

Guys, we are talking about USCIS - This agency issued visa extension to Mohammad Atta after his death - the guy who rammed AA plane into World Trade Center (9/11). Now can you imagine that? On one hand entire FBI and CIA was behind this tragedy and USCIS had no idea what they were doing. In my personal opinion, do not communicate with them in case you use AC-21. Just wait, if RFE comes RFE comes, if it gets approved it gets approved, if it gets denied, I am outta here! Read this if you have some time.

I filed for my ead in late september, got an rfe in mid nov, sent papers but see no change in status. how long does it take with an rfe to get ead? my 90 days are nearing and I am afraid with the holiday season coming, that I might not get in time. I have contacted my congressman, ombudsman's office can't do anything yet. what can be done?

Ok, I've seen a lot of threads about go to the rally, actions items, I've reading a lot of guys saying dont ask for your receipt status, dont waste your time etc, etc.
Yes we did the rally we were great with all those signs, and appearing in the Indy TV but...
Question remains open:
1. When are they going to increase the GC quota?
2. When congress id going to do something?
I've the feeling that that's it we made our point but we are still with no GC, waiting receipts..............

I understand you don’t care about the United States and its people and you’re only interested in what you can gain from them but if you weren’t so blinded by greed you’d see this is something else they can give to you. Now I know why I took the route I did, I would have accomplished far less in my personal life with the likes of you. In fact, I may doing to much sharing my expertise with you. On July 31st we got an email informaing us that my wife's EAD is approved and card production is ordered. Again on August 4th we got an email stating that the case is approved. Now we are surprized because if the case was actually approved on July 31st, she may get a two years EAD, but if it was approved on August 4th, she may get the EAD for one year only, as our PD is current.
BTW, My approval CRIS email came on July 28th, and I have got my EAD card for two years validity.

Along same lines, I would like to ask, Mark or whoever in anti-immigration camp,
there are only 1M (may be little less) skilled workers looking for immigration and you have problem with that because all of them are not THE BRIGHTEST one, okay... well first understand, for THE BRIGHTEST we have EB1 which is working great. Now in America there is a lot of work which needs experienced and highly skilled worker and we have EB2 for that, apart from that we still have a lot of work which requires hitech skilled worker and for that we have Eb3. So by the definition system has already identified the need and have representation for those.
And secondly you have problem with those who came legally and are highly skilled and have followed all the rules since day 1, counts less that 1 million, you are not willing to give them GC on other hand there are 12M (actually 20 M) who can't even write their names in English and everybody is ready to give them GC even the president of US is ready.
Doesn't that give signal that US is pro illegal and anti-legal immigration.... think about it

I do not think there 100K people in 2006+2007 PD. Thats a wild assumption. There is only 65k quota. I think 30K or 40K labor approvals during 2 years makes more sense to me.

I think there are people who have a labor pending from July 4th 1776 , so they might take the date back to July 4th 1776 when the US was formed and when the USCIS was established . However they will then not allow people living in the west coast and the then Confederate states to apply , only people living in the Union states will be eligible to apply .
